Driving Ban & up to £1000 Fine for Using a Phone Whilst Driving

Getting Banned from driving can be very unsettling. As your life's daily routine can be affected immensely if you rely on your care to get about. Well, using a phone or even a sat nav whilst you are driving could lad you with a hefty fine, 6 penalty points or banned from driving. Did you know that it is illegal to hold a phone or sat nav while driving or riding a motorcycle. The law says that, "you must have hands-free access, such as:

  • a bluetooth headset

  • voice command

  • a dashboard holder or mat

  • a windscreen mount

  • a built-in sat nav

The device must not block your view or the road and traffic ahead."


The Police can stop you if you are not in control of your vehicle at any time and you are distracted. You may be committing a criminal offence and you may be prosecuted.


When can I use a hand-held phone when in control of a vehicle. The law says that "you can use a hand-held phone if either of these apply:

  • you’re safely parked

  • you need to call 999 or 112 in an emergency and it’s unsafe or impractical to stop."


Penalties If you are in contravention of the law, you can get 6 penalty points and a £200 fine if you use a hand-held phone when driving. You can be prosecuted and taken to court, "you can:

  • be banned from driving or riding

  • get a maximum fine of £1,000 (£2,500 if you’re driving a lorry or bus)"
